Receiving reports under the Whistleblower Protection Act

In accordance with Act No. 171/2023 Coll., on the Protection of Whistleblowers (the "Whistleblower Protection Act"), BRM AERO s.r.o. (the "Company") has established an internal reporting system and designated a competent person to receive and handle reports under the Whistleblower Protection Act.

The Company, through the designated competent person, will thoroughly examine all reports received through the internal reporting system, respecting the rights of both the whistleblowers and the persons concerned by the report. All information will be handled with maximum confidentiality.

The following information summarises the options available to whistleblowers for submitting reports within the system established by the Company.

Reports

In accordance with the Whistleblower Protection Act, the Company accepts reports containing information about possible unlawful conduct that has occurred or is to occur at the Company and that has the characteristics of a criminal offence, or of a misdemeanour for which the law provides for a fine with an upper limit of at least CZK 100,000, or that violates the Whistleblower Protection Act, or that is contrary to legal regulations in the areas of:

  • financial services, statutory audit and other assurance services, financial products and financial markets
  • corporate income tax
  • prevention of money laundering and terrorist financing
  • consumer protection
  • compliance with product requirements, including product safety
  • safety of transport, carriage and road traffic
  • environmental protection
  • food and feed safety and the protection of animals and their health
  • radiation protection and nuclear safety
  • competition, public auctions and public procurement
  • protection of internal order and security, life and health
  • protection of personal data, privacy and the security of electronic communications networks and information systems
  • protection of the financial interests of the European Union
  • functioning of the internal market, including the protection of competition and State aid under European Union law

Submitting a report

In writing

  • By email to martin.brmaero@gmail.com
  • By letter addressed to Letecká č. ev. 255, 686 04 Kunovice, Czech Republic. The envelope must be marked "NEOTVÍRAT, VÝHRADNĚ K RUKÁM PŘÍSLUŠNÉ OSOBY" (Do not open, exclusively for the hands of the competent person).
  • Via the dedicated mailbox marked "Whistleblowing", located at the entrance to hangar No. 5, next to the attendance terminal.

Orally

  • By phone on +420 608 306 338
  • In person, at the whistleblower's request, within 14 days of the request, at the Company's registered office or at another agreed location.

It is up to the whistleblower to choose which of these methods to use.

Reports may also be submitted through the external reporting system of the Ministry of Justice of the Czech Republic at oznamovatel.justice.cz.

The Company notes that, in accordance with Section 9(2)(b) of the Whistleblower Protection Act, it excludes the acceptance of reports from persons who do not perform work or other similar activity for the Company (such similar activity meaning professional internships, work placements and volunteering).

Processing of reports

Processing a report inevitably also involves processing the personal data of the whistleblower and the data contained in the report. The rules laid down by generally binding data protection legislation will always be observed when processing reports.

We recommend that whistleblowers consider which information is important for describing the conduct in the report and which may be unnecessary for its investigation, and omit the latter from the report.

All reports are further processed in accordance with the Whistleblower Protection Act. Only the competent person has access to the reports.

Personal data related to whistleblowing is processed by BRM AERO s.r.o., Letecká č. ev. 255, 686 04 Kunovice, Czech Republic (data controller), for the purpose of fulfilling its obligations under the Whistleblower Protection Act, and is retained for five years from the date the report is submitted. Reports may be submitted anonymously; however, providing identifying information enables the controller to fulfil its statutory communication and protection obligations. Data subjects have the right to access their data, to have it corrected or deleted (where applicable), to restrict its processing, and to lodge a complaint with the Czech Office for Personal Data Protection (uoou.gov.cz). Nature of reports

A person who makes a report should reasonably believe that it is based on truthful information. A person who knowingly makes a false report is not protected against retaliatory measures under the Whistleblower Protection Act and may, by such conduct, commit a misdemeanour.
